What is mediation?

Mediation is a voluntary and confidential process in which a neutral third party, called a mediator, helps people resolve disputes by facilitating communication, identifying needs and interests, and exploring potential solutions. A successful mediation can reduce the costs involved in a lawsuit and help avoid the uncertainty of taking a case to trial.

What is Arbitration?

Arbitration is a form of alternative dispute resolution (ADR) where the parties to a dispute agree to have a neutral third party, called an arbitrator, to hear the case and make a decision. Unlike mediation, where the mediator facilitates discussions but doesn’t impose a resolution, arbitration is more like a private court process where the arbitrator reviews evidence, listens to arguments, and then issues a binding or non-binding decision.
